TERMS OF USE & RENTAL CONDITIONS (OFFICIAL VERSION)

Welcome to suricarrental.com (hereinafter referred to as the “Website”). This Website is fully owned and operated by SR Suri Travel Sdn Bhd. By accessing, making a vehicle reservation, or utilizing our car rental services, you (hereinafter referred to as the “Renter/Hirer”) agree to comply with and be fully bound by the Terms and Conditions of Service below:

1. RENTAL RATES, EXTENSIONS & OVERTIME HOURS

• Minimum Rental: Rental rates are calculated based on a standard 24-hour cycle.
• Overtime Surcharges: Returns exceeding the original contract duration will be charged at a rate of 10% per hour of the daily rate, up to a maximum of 5 hours only. Delays exceeding 6 hours will automatically be billed as a full-day rental rate.
• Rental Extension: Should the Hirer intend to extend the rental period beyond the original confirmed date, the Hirer MUST inform the management office of SR Suri Travel immediately to ensure the extension of insurance coverage.
• Price Adjustments: Rental prices are subject to change without prior notice in the event of unforeseen circumstances, such as increases in maintenance costs, transport expenses, or government taxes.

2. CANCELLATION & REFUND POLICY

• Forfeiture of Booking Deposit: For any voluntary booking cancellations made by the customer at any time, the paid booking deposit of RM50.00 shall be strictly non-refundable and forfeited.
• Full Payment Cancellation Penalty: If the Hirer has settled the full payment for the rental, refunds resulting from cancellations are subject to the following penalty schedule.

  – 21 days or more prior to the rental commencement date: A 30% penalty of the total cost will be deducted.

  – 14 to 20 days prior to the rental commencement date: A 50% penalty of the total cost will be deducted.

  – 7 to 13 days prior to the rental commencement date: A 75% penalty of the total cost will be deducted.

  – Less than 7 days prior to the rental commencement date: A 100% penalty applies (No refund will be issued.

• Transaction Fees: Any currency exchange fluctuations, bank charges, or a 3% credit card processing fee will be deducted from any refund amount.  The refund process will be settled within up to 90 calendar days.
• No Refunds for Unused Rental Time: No refunds, either in part or in full, will be made for any unused portion of the rental period if the Hirer returns the vehicle earlier than the contracted date.

3. 150KM RADIUS LIMIT & ZONE SURCHARGES

• Geographical Radius Limit: Standard vehicle rentals are strictly restricted to driving within a 150-kilometer radius from the Kota Kinabalu City Centre (KKCC) only (e.g., Kota Kinabalu, Penampang, Tuaran, Papar, Kota Belud, Kundasang, Ranau, Tambunan, Beaufort, and Kuala Penyu).
• Out-of-Radius Zone Surcharges: Driving to areas or districts that exceed the 150KM radius is NOT included in the standard rental rates and will incur a one-time surcharge according to the following designated zones.

  – Zone 1 [Kudat / Sipitang / Keningau]: Additional RM50.00 (One-Time.

  – Zone 2 [Tenom / Nabawan]: Additional RM100.00 (One-Time.

  – Zone 3 [Pitas / Labuan]: Additional RM150.00 (One-Time.

  – Zone 4 [Sandakan / Beluran / Telupid]: Additional RM250.00 (One-Time.

  – Zone 5 [Tawau / Semporna / Lahad Datu]: Additional RM350.00 (One-Time.

• Prior Notification & Permission: Failure to notify the company regarding travel outside the 150KM radius or entering any of the zones listed above without permission may void vehicle security protections and insurance coverages.
• Cross-Border Restriction: All SR Suri Travel vehicles are strictly prohibited from being driven across international borders or into areas prohibited by law.
• Off-Road Restriction: Vehicles are strictly not for use on off-roads, unsealed roads, dirt tracks, plantation roads, or unmade road surfaces.

4. DRIVER’S ELIGIBILITY & SUPPORTING DOCUMENTS

• Driving License & Experience: The Hirer must possess a valid Malaysian Competent Driving License (CDL) or an International Driving Permit (IDP) with qualified driving experience of at least one (1) year. Probationary (“P”) license holders are strictly not accepted.
• Verification Documents: Copies of the Identity Card (IC)/Passport, physical driving license, and verification proof (such as a flight itinerary, boarding pass, or utility bill) must be submitted during verification. Failure to comply will grant the company the right to cancel the reservation automatically.

5. VEHICLE MAINTENANCE, NEGLIGENCE & DAMAGES

• Repair Liabilities: The Hirer accepts full responsibility to repair and replace with new original parts at current market value, plus labor costs, for any components that are damaged, lost, or stolen during the hire period.
• Scope of Negligent Damages: This includes, but is not limited to, scratches on the car body requiring re-painting, minor or major damage to front/rear lamps, broken/smashed windshields or windows, damaged wipers, upholstery stains/cigarette burn marks, and bent or detached fenders and bumpers.
• Engine Monitoring (Temperature/Fluids): The Hirer must ensure that the vehicle’s water temperature remains at a normal level. Should the Hirer encounter overheating or a temperature rise, they must stop the car immediately in a safe area and contact our emergency response team. For long-distance driving, the Hirer must regularly inspect the radiator water level and engine oil.. Any engine damage caused by failure to monitor vehicle temperature is the sole responsibility of the Hirer.
• Key Loss Penalty: If the Hirer loses the vehicle key (smart key, remote, or physical key), a replacement fee of RM400.00 will be charged immediately.

6. GENERAL INSURANCE, EXCESS LIABILITY & COLLISION DAMAGE WAIVER (CDW)

• Standard Insurance Cover: Rental rates include full indemnity for accidental damage to third-party property and bodily injuries. However, in line with commercial insurance practices, the customer is always held liable for a maximum excess clause amount depending on the vehicle group category.

  – Group A (Below 2000cc): Maximum RM3,000.

  – Group B (At 2000cc): Maximum RM5,000.

  – Group C (Above 2000cc): Maximum RM10,000.

  – Group D (Luxury Class): Maximum RM15,000 and above.

• Optional CDW Protection Tiers: To waive or reduce the massive standard financial excess liability, the Hirer is highly encouraged to purchase one of the optional Collision Damage Waiver (CDW) protection tiers below:

  – 1. Basic Protection CDW (+RM12.00 / Day): Standard basic coverage. Significantly reduces your accident excess liability up to a maximum cap of RM1,800 per accident.

  – 2. Standard Protection CDW (+RM28.00 / Day): Medium protection. Significantly reduces your accident excess liability up to a maximum cap of RM1,200 per accident.

  – 3. Premium Protection CDW (+RM38.00 / Day): High-level protection. Reduces your accident excess liability to the absolute minimum allowed cap per accident (as specified based on the vehicle group).

• CDW Terms of Validity: In the event of an accident, the Hirer MUST immediately notify and consult SR Suri Travel management PRIOR to filing an official police report. CDW coverage will only be effective subject to the submission of an official Police Report within 24 hours from the time of the accident. Acceptance of CDW does not cover missing accessories, under-carriage damage, or upper-carriage damage caused by negligent driving as stipulated in our terms.

7. CLEANLINESS, ODORS & PROHIBITED SUBSTANCES

• Odor Fine (Smoking/Durian): Smoking, vaping, consuming alcohol, or carrying items with an unpleasant or pungent odor (such as durian, cempedak, salted/dried fish, etc.) inside the vehicle is STRICTLY PROHIBITED. A penalty fee of RM300.00 will be imposed immediately to cover professional cleaning, odor removal, and interior disinfection costs.
• Cleanliness Fine: Vehicles are delivered in a clean condition and must be returned in the same state. If a vehicle is returned excessively dirty (heavy mud stains, interior trash accumulation, widespread food debris), a cleaning fee of RM50.00 will be applied.

8. SECURITY DEPOSIT, TRAFFIC FINES & VEHICLE REPOSSESSION

• Refundable Security Deposit (RSD): In addition to rental charges, the Hirer must provide a security deposit via cash/card as a guarantee of proper vehicle usage. This sum will be fully reimbursed within 7 working days after returning the vehicle, provided no damages or traffic summonses are reported.
• Traffic Fines & Administration Fees: The Hirer is fully responsible for all parking fees, toll charges, and traffic fines incurred during the rental period.  An additional administration fee of RM50.00 will be charged to the Hirer on top of any traffic fine settled by the company on the Hirer’s behalf.
• Failure to Return & Repossession: If the Hirer fails to return the vehicle within 3 hours from the end of the rental period without notice, the company reserves the right to track the vehicle’s location via GPS and take all lawful repossession actions. A repossession charge of RM150.00 will be levied against the Hirer. If the Hirer remains unreachable within 48 hours, the vehicle will immediately be reported as stolen to the police.
• Lost and Found: The company takes no responsibility for keeping or storing personal belongings left in the vehicle after return. The Hirer is solely responsible for checking their property prior to vehicle handover.

9. SUBMISSION OF DATA TO AUTHORITIES & BLACKLISTING (CTOS)

• Data Submission: The Hirer hereby grants absolute permission to SR Suri Travel Sdn Bhd to submit their personal or company particulars to relevant law enforcement or government authorities (Royal Malaysia Police, JPJ, etc.) if found or suspected of conducting illegal trades or breaching statutory rules.
• Credit Rating and CTOS Blacklist: The company reserves the absolute right to blacklist the Hirer and submit their details to the CTOS credit rating system with immediate effect if the Hirer accumulates unpaid rental debts, unresolved traffic summons debts, or criminal records[.: 1]. Any blacklisted Hirer will be charged an extra 30% or RM150.00 (whichever is higher) of the total outstanding debt amount.

10. WAIVER OF LAWSUIT

The Hirer covenants and agrees that they will not file any suit in any court of law (or join any suit, or accept relief in any suit) against SR Suri Travel Sdn Bhd or any of the released parties asserting, pleading, or raising any claims or liabilities released or waived under this digital rental agreement.
